The Court of His Majesty the Sovereign is the highest judicial power in Loquntia and deals with all types of cases whether they are appealed, or if there isn't a court available in a lower jurisdiction. It is currently the only court under which cases can be filed in Loquntia, and it may remain so for a while.
The Court of His Majesty the Sovereign
Though it's gone by many names, but the final of which is defined in the Loquntian Constitution. The Court of His Majesty the Sovereign is the second-oldest government entity in Loquntia, younger only to the Library of Blue Ink which predates the founding of Loquntia. Throughout its short history, the court hasn't had a ceremonial venue, it only convenes when and where necessary, typically by secret appointment.
Each case is carried out using a system of motions and petitions with the justice asking questions in between. Cases are typically civil and criminal cases, though marriages and constitutional grievances are still common-place. All records are public unless they have been filed under seal, and are available from the Library of Blue Ink along with the ability to file motions, petitions, and requests with the court online.
The court works on the same schedule as the Parliament, except instead of a summer recess in July, the month of December is omitted. Each day except for Sunday is called an in camera day. Cases can only occur on dates in camera and most court proceedings are public.
The court can also notarize agreements, after which the master copy may be filed with the court and are admissible anywhere in Loquntia.
The current system that the court employs is under mandate of a royal decree filed on February 28, 2015. One notable procedure is the swearing in of parties, they are required to swear to one of three oaths, one swearing to God, one by Allah, and one for persons who are not religious.
All court records belonging to the Court of His Majesty, the Sovereign are stored on file and available upon request unless they are filed under seal.
In order to be a justice in the SCORKL, one must first be a Lord Royal Esquire Minor, a degree granted to those barristers who have surpassed all others; and in order to the chief justice one must be the Lord Royal Esquire, an educational degree that only one person may hold at a time.
Loquntia v. Stone and Stone v. Loquntia
After one of the co-founders of Loquntia was tried for treason, the former statute for treason was found unconstitutional and a right not written in the constitution was cited as the cause, summarised in the original verdict as follows:
"it is a natural right that no person may be held to answer for a crime which, in premise is so ambiguous and vague that the probable cause to believe that the crime has been, is being, or will have been committed is or can be attained without the discovery and analysis of material fact."This landmark decision founded the precedent for all future cases involving civil rights in the enforcement of crimes.
